Christopher Gallegos is loving New Mexico bail reform – having been released three times in a row this year – despite the prosecutors filing for preventative detention.

In June – Gallegos was arrested for breaking into his parents home and threatening to kill is family. A judge ordered him released and FREE TO GO.

A month later – Gallegos crashed a stolen car running from police trying to escape arrest. A judge ordered him released and FREE TO GO.

A month later – Gallegos was arrested after he broke into a woman’s home and for charges of breaking into a car dealership to steal cars.  Judge Loveless ordered him released and FREE TO GO.

Each time, Gallegos was released under NM Bail Reform after the Arnold Foundation’s “Pretrial Risk Assessment” tool determined that he was not a danger to the community or a flight risk and therefore should not be subject to any accountable release – just a “promise” to appear.

The release is the result of newly enacted Supreme Court guidelines orchestrated by Chief Justice Daniels that virtually eliminates accountable pretrial release and bail.

Judges deny three pretrial detention motions for repeat offender

A suspected repeat offender in Albuquerque was given not one, not two, but three chances to get out of jail free.

Each time prosecutors asked a judge to hold Christopher Gallegos without bond, saying he was a danger to the community, but the judges denied the request for pretrial detention. Gallegos has been arrested at least four times since June.

In June, police arrested Gallegos for allegedly trying to break into his parent’s home and threatening to kill his family inside. He was released from jail but didn’t stay out of trouble for long. A month later, police arrested Gallegos again after they say he stole a car and crashed it trying to get away from officers. He was also released from jail in that case.

Then on Aug. 11, police arrested Gallegos after he allegedly broke into a woman’s home. Four days later, Gallegos was still in jail when police tacked on more charges after connecting him to another case. They say he was caught on camera breaking into Galles Chevrolet and stealing cars.

In those last two cases, prosecutors asked Judge Jacqueline Flores to hold him without bond. But Judge Flores denied those requests. Gallegos was back in jail on Aug. 30, accused of vehicle theft. That time prosecutors asked Judge Brett Loveless to hold Gallegos with no bond, but Loveless denied their motion.
